2.1 Mr. Panna Lal Sharma accepts notice on behalf of the State. 3.

The petitioner seeks interim bail on the ground that his maternal grandmother is required to undergo knee surgery. The fact that this aspect has already been verified by the State is brought to fore by relying upon the verification report of SI, P.S. Mandawali, which is appended at page 141 of the paper book.

3.1 It is contended by the counsel for the petitioner that the material witnesses in the matter have been examined.

Both the aforementioned facts are not disputed by Mr. Panna Lal Sharma, who appears for the State.

4.1 It is also not in dispute that, although, the petitioner has been charged for an offence under Section 302 of the I.P.C., he has been in custody since 17.09.2013.

4.2 There is also no cavil with regard to the fact that the petitioner was granted interim bail only once, that too, on 08.06.2017 for a period of four weeks.

The record also shows that the petitioner has lost both his parents. The record is also suggestive of the fact that one of his maternal aunts, even though alive, is residing in Naugaon, Madhya Pradesh. It appears that because of the Coronavirus disease - 2019 [COVID-19] pandemic, she is unable to come down to Delhi to take care of her mother. 6.

The petitioner states that his sister, who, though an adult, is herself suffering from an intestinal ailment and, therefore, is not in a position to run around for the surgery involving her maternal grandmother. 7.

Given the aforementioned circumstances, I am inclined to grant interim bail to the petitioner for a period of three weeks commencing from the date of his release subject to the following conditions. (i) The interim bail will be conditional on the petitioner furnishing a personal bond of Rs. 10,000/- and one surety of the equivalent amount to the satisfaction of the duty Magistrate.

(ii) It is made clear that the petitioner will surrender before the concerned Jail Superintendent upon expiry of the aforementioned period. (iii) Furthermore, the petitioner will furnish his permanent address to the concerned Jail Superintendent.

(iv) The petitioner will keep the Station House Officer, Shakarpur [in short "SHO"] informed about his movements. For this purpose, the petitioner will establish contact, telephonically, with the SHO every third day at about 11.00 A.M.

(vi) It is also made clear that the petitioner will not leave the National Capital Territory of Delhi without prior permission of the Court. 8.

The Registry is directed to transmit a copy of the order passed today electronically to the concerned Jail Superintendent and the SHO. 9.
