BAIL APPLN. 931/2020 1.
This application has been filed by the applicant under Section 439 Cr. P.C. seeking interim bail in FIR No.143/2017 registered at Police Station, Neb Sarai. 2.
It is asserted that the applicant's wife requires removal of her Gallbladder for which purpose she has been advised to be admitted to the hospital on 25.05.2020 with the surgery scheduled for 26.05.2020. It is further asserted that the petitioner's family consists of himself, his wife and a five years old child and there is no one else in the family to look after the wife of the applicant during the period of her treatment. It is further asserted that the public witnesses in the trial have already been examined.

The learned APP for the State has confirmed the medical condition of the
wife of the applicant.

Keeping in view the above facts, the applicant is granted interim bail for a period of thirty days (30 days) from the date of his release, subject to the applicant furnishing a personal bond in the sum of Rs.15,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/Duty Magistrate. However, the grant of interim bail is subject to the following further conditions:- i.
The applicant shall not try to get in touch directly or indirectly with any of the prosecution witness and shall not make any effort to tamper with the evidence;
ii.
the applicant shall report to the IO/SHO of Police Station, Neb Sarai on every Monday during the period of release; iii.
the applicant shall also give his mobile number to the concerned SHO/IO where he can be contacted at any time; iv.
the applicant shall not leave the jurisdiction of NCT of Delhi; and v.
the applicant shall voluntarily surrender to the jail superintendent after the expiry of the release period.

The application stands disposed of in the above terms. 6.
A copy of this order be communicated to the concerned Jail Superintendent electronically.
