% 08.08.2017 IA No.8532/2017 This application has been moved by the parties under Order 23 Rule 3 of the CPC pursuant to settlement before the Mediation and Conciliation Centre, Delhi High Court, New Delhi vide a settlement agreement dated 08.08.2017.

The settlement agreement has been filed on record. Pursuant to such settlement, the defendant nos.2,3 and 4 has handed over the drafts of `40,00,000 to the plaintiff. The terms of settlement has been mentioned in para No.7 of the settlement agreement dated 08.08.2017.

The criminal complaint under section 138 of Negotiable Instruments Act, 1881 shall be withdrawn by the plaintiff. The plaintiff shall also cooperate for quashing of the FIR No.436/2014 pending in Police Station Maurya Enclave, Delhi under sections 406/420/467/468/471/ 120B/34 of IPC.

Learned counsel for plaintiff seeks leave to withdraw the suit. Accordingly, the suit of the plaintiff is dismissed as withdrawn having been settled. The plaintiff shall be entitled to refund of Court Fees per Section 16A of the Court Fees Act. Original documents filed on record by the parties be returned to them as per rules. Decree Sheet be drawn accordingly. The settlement shall be a part of the decree.
