The present Appeal under Section 37(2)(b) of the Arbitration and Conciliation Act, 1996, challenges the impugned Order dated 24.02.2026 passed by the learned Arbitral Tribunal. 2.

Pursuant to the Order dated 22.05.2026, the Respondent has placed on record an affidavit delineating the circumstances under which the arbitral proceedings came to be initiated. From the contents thereof, and as fairly conceded by learned counsel appearing for the Respondent, it transpires that, owing to an erroneous understanding and advice, the appointment of the learned Arbitrator and the consequent continuation of the arbitral proceedings came to be undertaken.

vide Order dated 22.05.2026, there is no further requirement of keeping this matter pending. The Affidavit is already on record as per the directions.
