Learned counsel for the appellant states on instruction from his client that in view of the fact that the respondent has sold his share in the suit premises to a third party after the impugned judgment dated 15.01.2019 came to be passed by executing a sale deed on 12.02.2019, he seeks leave to withdraw the appeal.

Leave, as prayed for, is granted. The appeal is dismissed as withdrawn along with the pending application.
