A request for an adjournment is made on behalf of the petitioner, on the ground that the main counsel is not available. 2.

A perusal of the proceedings would show that on account of repeated adjournments, cost of Rs.5,000/- was directed to be paid, which has not been paid till date.

Learned counsel for the respondent submits that meanwhile, the petitioner has already been declared a proclaimed offender by the Trial Court.

Considering the fact that repeated adjournments have been sought without there being any sufficient cause, the petition along with pending applications is dismissed in default for non-prosecution.
