In view of the above, this Court is inclined to dispose of the present petitions, with the liberty to the Petitioner to approach this Court again if the occasion so arises, so that the bar under Order XXIII Rule 1(4)(b) of the Code of Civil Procedure, 1908, is not attracted in terms of the judgment of the Apex Court in HPCL Bio-Fuels Ltd. v. Shahaji Bhanudas Bhad, 2024 SCC OnLine SC 3190.
