Counsel appearing on behalf of the petitioner submits that in view of the fact that the respondent company is situated outside India, the proposed arbitration proceedings would be in the nature of 'International Commercial Arbitration', in terms of Section 2(1)(f)(ii) of the Arbitration and Conciliation Act, 1996.

Accordingly, the counsel for the petitioner seeks to withdraw the present petition with liberty to approach the Supreme Court in accordance with law.

The petition is dismissed as withdrawn with the aforesaid liberty.
