The hearing has been conducted through Video Conferencing. 2.

This Writ Petition is filed by the petitioner seeking a Writ or direction in favour of the petitioner and against the respondent quashing the impugned Fee Bill raised by respondent No.2/School for the First Quarter of Academic Year 2020-21.

The basic grievance of the petitioner in the Writ Petition is that the respondent No.2/School has charged more than the tuition fee which they are permitted to charge in the ongoing shutdown due to Pandemic. 4.

Learned counsel appearing for respondent No.2 states that the respondent No.2 is not charging any fee other than tuition fee from the students during the current shutdown and is complying with the directions of the State Government dated 18.4.2020. The said statement of respondent No.2 is taken on record. Respondent No.2 shall abide by the same.

It appears that there is some other controversy between the parties. W.P.(C) 3207/2020

The father of the petitioner appears to have recorded some of the online classes to which respondent No.2 has objected stating it to be invasion of the privacy of the students who are attending the class. On this account the access of the petitioner to the Online Classes was declined. 6.

Learned counsel for the petitioner states on instructions that the petitioner or his family members shall not record the online classes being undertaken by respondent No.2 in any manner whatsoever. I may also add that the father of the petitioner has filed an affidavit placing an undertaking on record. The parents of the petitioner shall remain bound by the undertaking given in court today and by the Additional affidavit filed in compliance of order dated 20.5.2020.

The respondent No.2/School shall forthwith allow the petitioner to have access to the Online Classes. The respondent No.2/School shall accordingly take appropriate steps to ensure that the petitioner is able to join the Online classes w.e.f. 1.6.2020 i.e. Monday.

Since nothing further survives in the petition, the petition stands disposed of. All pending applications, if any, also stand disposed of. 8.

A copy of this order be sent by the Court Master through email to learned counsel for respondent No.2.
