CRL.M.C. 1480/2020 1.
The present application has been taken up for hearing through video conferencing.
2.
This is an application filed by the prosecutrix seeking cancellation of the interim bail for a period of one month, granted to the respondent no.2/accused vide order dated 16.05.2020 passed by the learned Additional Sessions Judge, Patiala House Courts. 3.
Learned counsel for the petitioner submits that the petitioner is apprehensive that the accused/respondent no.2, who is in possession of a licensed weapon, may use the weapon to threaten her on being released on bail. It is, therefore, prayed that the interim bail granted to
him be cancelled forthwith.
4.
On the other hand, learned counsel for the respondent no.2/accused while submitting that the said respondent is already released on interim bail, denies this allegation and submits that the accused does not possess any weapon. He further submits that the said respondent had merely obtained an arms license in anticipation of purchasing a weapon, which he has now elected not to and has, accordingly, submitted an application for cancellation of the license existing in his name.
5.
In view of the aforesaid, learned counsel for the petitioner seeks leave to withdraw the application with liberty to approach the Court, in case any ground is made out in the future for seeking cancellation of the interim bail granted to the accused/respondent no.2. 6.
The application stands dismissed as withdrawn with liberty as prayed for.
7.
The order be uploaded on the website forthwith. Copy of the order be also forwarded to the learned counsel through email. REKHA PALLI, J MAY 20, 2020 Sr
