The petitioner present in person submits that he would not press this petition if the penalty of Rs.1,41,698.98/- is waived. 2.

Learned standing counsel for respondent on instructions from Mr. Sudhip Bhattacharya, DGM Enforcement, submits that as special case, the respondents agrees to waive off the penalty amount of Rs.1,41,698.98/- subject to the petitioner regularly paying the user charges according to the non-domestic tariff. It is further prayed that this case should not be treated as a precedent.

The petitioner agrees to regularly pay the user charges according to the non-domestic tariff.

The petition and pending applications are disposed of in terms of the statement of the parties. This case shall not be treated as a precedent. 5.
