Pursuant to previous order dated 29.01.2024, an affidavit has been filed by Mr. Ajit Kumar, Liquidator for plaintiff company. The said affidavit states that he was appointed as a Liquidator vide order dated 02.05.2023 passed by the NCLT and is in control and custody of all assets and documents. 2.

The Liquidator, who appears through VC, submits that he is aware of the application for patent filed by plaintiff company which was submitted on 25.02.2002 and has since expired in 2022. It is therefore, stated that the suit itself has become infructuous. By the said affidavit, the Liquidator confirms that the suit should accordingly be withdrawn.
