This petition challenges the order dated 14.08.2019 passed by the learned Metropolitan Magistrate-03 (South), Saket Courts, New Delhi declaring the petitioner as an absconder.

The learned counsel for the petitioner prays for leave to withdraw the present petition with liberty to approach the learned Trial Court by way of an application seeking appropriate relief. He submits that presently the petitioner is in Mumbai and apprehends that coercive action may be taken against him on his coming to Delhi.

Having considered the submissions made, the present petition and the pending applications are dismissed as withdrawn with liberty to the petitioner to approach the learned Trial Court by way of an appropriate application. Further,
subject to the condition that such application is filed by the petitioner before the learned Trial Court within a period of three weeks from today, no coercive action shall be taken against him for enforcement of the Impugned order dated 14.08.2019 till such application filed by petitioner is considered by the learned Trial Court.
