This petition is preferred on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the Arbitral Tribunal by a period of 12 months.

Disputes having arisen between the parties in relation to a Franchise Agreement dated 20.06.2015, this Court vide order dated 09.11.2020 in ARB. P. No. 425/2020, appointed a Sole Arbitrator. On 08.02.2023, mandate of the Arbitrator was extended by this Court in O.M.P. (MISC.)(COMM.) 237/2022 till 07.02.2024. Subsequently thereto, arguing counsel of the Respondents passed away and proceedings were deferred for a while. On 27.02.2024, this Court in O.M.P. (T) (COMM) 47/2024 appointed a substitute Arbitrator as the earlier Arbitrator recused and also extended the mandate. of cross-examination of departmental witness. 3.
Mr. Puneet Bhardwaj, learned counsel appearing on behalf of the Respondent, on instructions, submits that Respondent has no objection to the extension of the mandate of the learned Tribunal by a period of one year. 4.
Accordingly, with the consent of the parties, mandate of the Arbitral Tribunal is extended by a period of 09 months from 03.04.2025. 5.
Petition is allowed and disposed of in the aforesaid terms.
