The petitioner in the present petition is a citizen of Iran and is stated to be currently employed with Lancers International School, DLF 5, Sector53, Gurugram, Haryana. An employment visa dated 14.10.2021 was issued to the petitioner for a period between 22.11.2021 to 21.11.2022. The said visa was periodically extended and was last extended on 23.10.2023with a validity upto 15.10.2024.

Subsequently, since the visa of petitioner was slated to expire on 15.10.2024, the petitioner filed an application being Application ID No. 160924QWO6MU on 23.09.2024 for extension of the employment visa. 5.

despite having duly submitted the application for grant of extension of employment visa vide application ID No.160924QWO6MU to respondents, along with the requisite documents, the said application has not been decided till date. It is submitted that the petitioner had submitted the application well before expiry of the existing employment visa. However, there has been inordinate delay on the part of the respondents in taking requisite decision even after submission of the Police Verification Certificate (PVC) to the respondent no.1 which was released after the petitioner's visit to the concerned Police Station. 6.
Learned counsel for the respondent, who appears on advance notice submits that the requisite decision on the petitioner's application for extension of employment visa shall be taken within a period of two weeks from today under intimation to the petitioner. 7.
During the course of proceedings it has been brought out that a criminal proceeding is pending against the petitioner. Learned senior counsel for the petitioner submits that the pending criminal proceedings qua the petitioner cannot possibly be an impediment to processing the application of the petitioner seeking extension of employment visa inasmuch as the same pertains to recovery of the petitioner's outstanding dues from her ex-employer; the same does not involve any moral turpitude, or any offense that poses a threat to public order or national security. This aspect shall also be considered by the respondent, while processing the application of the petitioner.
