% 21.05.2020 CM APPL. 11201/2020 (exemption) Exemption allowed, subject to all just exceptions. W.P.(C) 3219/2020 & CM APPL. 11200/2020 This Writ Petition is filed by the petitioner seeking to impugn the order dated 15.2.2020.

A perusal of the order dated 15.2.2020 shows that a cost of Rs.20,000/- was imposed upon the Management/Petitioner on account of an adjournment sought for cross-examination of WW1. Learned counsel for the petitioner submits that the petitioner sought an adjournment only for the first time and the reason for the same was that the affidavit by way of evidence of WW1 was not available with the learned counsel for the petitioner as the petitioner had gone out of town and had not forwarded the same to the learned counsel. She further submits that there are a total of 4 matters which were listed on that date and in each matter a cost of Rs.20,000/- had been imposed. It is pleaded that hence essentially a cost of Rs.80,000/- has been imposed on the petitioner for the single date sought.

Keeping in view the pleas of learned counsel for the petitioner,

liberty is granted to the petitioner to move an appropriate application before the concerned Labour Court for waiver/modification of the order dated 15.2.2020/cost imposed. In case such an application is filed by the petitioner the learned Labour Court is requested to consider the application keeping in the view the submissions made by learned counsel for the petitioner.

With the above directions, the present Writ Petition is disposed of. All pending applications, if any, also stand disposed of accordingly. JAYANT NATH, J.
