By virtue of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 the applicant seeks grant of interim bail for a period of one month in proceedings arising out of FIR No.337/2024 dated 15.08.2024 registered at PS: Patparganj Industrial Area under Sections 406/408/420/120B of the Indian Penal Code, 1860 (IPC).

outstanding school fees amounting to Rs.34,000/- and Rs.30,000/- are to be paid immediately otherwise their admissions are likely to get cancelled. He further submits that since the wife of the applicant has recently suffered a pregnancy with medical complications which resulted in a miscarriage, their savings were exhausted in the process, so he needs to arrange for the requisite funds afresh for the education of his daughters or else he and they would be gravely prejudiced. 3.
Per contra, learned APP for State, drawing the attention of this Court to the Status Report submits that the offences involved are serious in nature as more than Rs.3 Crores have been misappropriated by the applicant. She further submits that as per the reply of the School authorities dated 13.05.2026, the younger daughter of the applicant did not attend school from October, 2025 to March, 2026. 4.

As per facts, there is no denial that the applicant has two minor School going daughters whose fees are outstanding, as per verification by the School authorities dated 13.05.2026, and as has also not been disputed by the prosecution. In fact, the younger daughter of the applicant has not attended School from October, 2025 to March, 2026. In view thereof, and even though the offence and the quantum involved in the present proceedings against the applicant are grave, adopting a humanitarian approach towards them, and their future, when their right to education ought not to suffer because of their father facing incarceration this Court under the facts and circumstances herein is inclined to grant interim bail to the applicant, albeit, for a limited/ short period only. This Court also finds that as per the Nominal Roll received, the conduct of the applicant while in custody has been "Satisfactory". 7.
As such, the present application is allowed and the applicant is granted interim bail for a period of two weeks from the date of his release in proceedings arising out of FIR No.337/2024 dated 15.08.2024 registered at PS:
Patparganj Industrial Area under Sections 406/408/420/120B IPC, subject to the following conditions:- (i) The applicant shall furnish a personal bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount, to the satisfaction of the concerned Jail Superintendent.
(ii) The applicant shall not leave NCT of Delhi without prior permission of the learned Trial Court and shall ordinarily reside at his address as per prison records.
(iii) The applicant shall also surrender his Passport, if any, to the concerned Jail Superintendent.
(iv) The applicant shall not contact/ visit/ offer any inducement/ threaten/ promise/ attempt to influence any of the prosecution witnesses or other persons acquainted with the facts of case. The applicant shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial.
