% 22.05.2020 [Hearing held through video conferencing] CRL.M.A.6692/2020 1.
For the reasons stated in the application, the same is allowed. BAIL APPLN. 979/2020 2.
The petitioner has filed the present petition seeking interim bail in FIR No.0126/2018 under Section 18/25 of the Narcotic Drugs And Psychotropic Substances Act, 1985 registered with PS Crime Branch. It is alleged that the petitioner was found in possession of commercial quantity of Opium.
3.
The petitioner has sought interim bail on the ground that his wife has been advised hysterectomy and he required to attend to his wife. The petitioner and his family are residents of Amroah, Uttar Pradesh. Admittedly, the petitioner has four children. Two of whom are major (son aged 20 years and daughter aged 21 years). However, Mr Kaushik, learned counsel appearing for the petitioner states that children are also not well.
There is no document on record to establish the same. This Court is also of the view that since the petitioner has a daughter aged about 21 years, she is fully capable of attending to her mother. Thus, the petitioner's contention that there is no other person to attend to his wife is not merited. 4.
The petition is, accordingly, dismissed.
