None appears on behalf of the Petitioner.

There has been no appearance on behalf of the Appellant since 22.12.2021.

The order dated 22.08.2022 records that the Appellant has not taken steps to serve the Respondent and thus, the Court granted further opportunity to the Appellant to take steps for serving Respondent. However, as per the office report, no steps were taken by the Appellant even thereafter to serve Respondent.

Since then, the matter has been listed on several occasions, however there has been no appearance of Appellant or its counsel. 5.

In fact, non-prosecution by the Appellant/Complainant was the reason why learned MM-02 (NI ACT) South District, Saket Courts, Delhi vide impugned order dated 03.11.2017 has dismissed the Criminal Complaint No. 1121/2017 filed by the Appellant under Section 138 of Negotiable The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Instruments Act, 1881. It is thus apparent that Petitioner is not diligent in prosecuting the case.
