The present suit has been filed by the plaintiff praying for a decree of partition with regards to the suit property i.e., Plot No.4, South Extension Co-Operative House Building Society, South Extension Part-I, New Delhi admeasuring 200 sq. yards.

During the pendency of the present suit, the parties were referred to mediation by this Court vide order dated 02.04.2024 where the parties have arrived at a settlement, terms whereof have been reduced in writing in the form of a Settlement Agreement dated 16.10.2024, a copy of which is on record.

A perusal of the said Agreement shows that the same has been signed by the plaintiff and the defendant, as well as, by their respective counsels apart from the learned Mediator.

Learned counsel for the parties urges the Court to decree the suit in terms of the said Settlement Agreement.

A reading of the terms of settlement shows that the same are lawful, therefore, there is no impediment in decreeing the suit in terms thereof. The parties shall remain bound by the terms of the said settlement. 6.
In view of the above, the suit is decreed in terms of the Settlement Agreement dated 16.10.2024, which shall form part of the decree. 7.
Consequently, the interim order passed by this Court stands vacated. The suit along with pending applications stands disposed of in the above terms.
