After some arguments, learned counsel for the appellant states that he would be satisfied if this Court were to clarify that the Financial Commissioner shall consider all contentions and submissions advanced by all the parties.

A perusal of the impugned order reveals that the learned Single Judge has directed the Financial Commissioner to consider the matter de novo. In any event, to avoid any controversy, this Court clarifies that the Financial Commissioner shall consider all the contentions and submissions advanced by all the parties.

With the aforesaid clarification/observation, the present appeal along with pending applications is disposed of.
