The present petition has been filed by the Petitioner-M/s Bharat Rail Automations Pvt. Ltd. under Section 29A of the Arbitration and Conciliation Act, 1996 (hereinafter, 'Act') seeking extension of the mandate of the Arbitrator.

The background of the present petition is that vide order dated 2nd December, 2021 in OMP (T) (COMM) 67 of 2019, a sole arbitrator was appointed to adjudicate the disputes between the parties in terms of Clause 40 of the Letter of Acceptance dated 4th October, 2010. It is the case of the Petitioner that the ld. Arbitrator commenced proceedings on 12th July, 2022. Notice of the present proceedings was served to the Respondent on 16th March, 2023. On 12th July, 2023 the mandate of the ld. Arbitral Tribunal was extended with the consent of parties to 6 months. to an end. Hence, the present petition.
