% 26.05.2020 Vide the present application, the applicant seeks the grant of interim bail submitting inter alia to the effect that the petitioner's mother is to be operated upon for a knee replacement/surgery as well as a Hernia operation. As per the averments made in the application, it has been submitted on behalf of the applicant that the parents of the applicant are wholly dependent on the applicant and that there is no one else to take care of them and the applicant is the only bread earner. On behalf of the State, it has inter alia been submitted that the allegations levelled against the applicant are related to the gang rape. Without any observations on the merits or demerits of the prayer that has been made on behalf of the applicant, in as much as, even the date of the surgery is not yet fixed, learned counsel for the applicant at this stage seeks to withdraw the present application seeking liberty to file

it afresh after the date of surgery is fixed. In view thereof, the present application is thus dismissed as withdrawn, as prayed. ANU MALHOTRA, J MAY 26, 2020 'neha chopra'
