O R D E R

By virtue of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, the applicant seeks grant of interim bail for a period of thirty days in the proceedings arising out of FIR No. 360/2021 dated 18.10.2021 registered at PS.: Krishangarh, Delhi under Sections 307/201/120B/34 of the Indian Penal Code, 1860 (IPC) and under Sections 25/27/54/59 of the Arms Act, 1959 (Arms Act) and all other proceedings emanating therefrom. 2.

At the outset, learned APP for the State has handed over a copy of Status Report, which is taken on record.

owner of a property, i.e., No.382/18, Ram Nagar, Bahadurgarh, Haryana124507, intends to sell the same to a buyer as his niece is in urgent need of funds to meet the expenses incurred towards the aforesaid marriage. He submits that the presence of the applicant is indispensable for the said sale as he is a joint owner of the property.

Learned APP for the State, whilst relying upon the Status Report, submits that the document(s) of the said property and the General Power of Attorney dated 04.05.2026 stands verified as also the buyer of the said property has confirmed that he seeks to purchase the said property. 5.

Heard and perused the documents on record.

In view of the submissions made, the applicant, being the uncle, intends to fulfil his duty so as to effectuate the marriage of his niece financially, for which he intends to sell off the said property. Therefore, for proceeding therewith and for executing the requisite documents for the transaction and for registration thereof, his presence is required. As such, the present application is allowed and the applicant is granted interim bail for a period of two weeks from the date of his release in proceedings arising out of FIR No.360/2021 dated 18.10.2021 registered at PS.: Krishangarh, Delhi under Sections 307/201/120B/34 of the IPC and under Sections 25/27/54/59 of the Arms Act, subject to the following conditions:- (i) The applicant shall furnish a personal bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount, to the satisfaction of the concerned Jail Superintendent.

(ii) The applicant shall not leave NCT of Delhi without prior permission of the learned Trial Court and shall ordinarily reside at his address as per prison records and if he wishes to change his residential address, he shall immediately intimate about the same to the concerned IO by way of an affidavit.

(iii) The applicant shall also surrender his Passport, if any, to the concerned Jail Superintendent.

(iv) The applicant shall not contact/ visit/ offer any inducement/ threaten/ promise/ attempt to influence any of the prosecution witnesses or other persons acquainted with the facts of case. The applicant shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial.

(v) Upon expiry of the period of two weeks of interim bail from the date of his release, the applicant shall surrender before the concerned Jail Superintendent on or before 04:00 PM on the said date of expiry of the interim bail.

As such, the present application is disposed of in the above terms. 8.

A copy of this order be sent to the concerned Jail Superintendent for information and compliance forthwith.
