This petition is preferred on behalf of the Petitioner under Section 11(6) of the Arbitration and Conciliation Act, 1996 ('1996 Act') for appointment of an Arbitrator.

Mr. Jagder Singh, learned counsel enters appearance on behalf of the Respondent and on instructions, submits that Respondent is willing to amicably settle the matter and pay an amount of Rs.17,47,000/- to the Petitioner within six months in equal instalments in full and final settlement of all the claims of the Petitioner. Learned counsel for the Petitioner, on instructions, accepts this proposal.

Accordingly, this petition is disposed of taking on record the undertaking of the Respondent that he shall pay a sum of Rs.17,47,000/- to the Petitioner within six months in equal instalments. Affidavit of undertaking shall be filed by the Respondent within two weeks from today. Respondent has been explained the consequences of violation of the undertaking given to the Court.
