A Petition under Section 482 of BNSS has been filed on behalf of the Petition for grant of Anticipatory Bail in case FIR No.686/2024 under Section 70(2)/137(2)(B)/140(3)/142/115(2) BNS, 2023 and Section 6 of POCSO Act registered at Police Station Sarai Rohilla. 2.

It is submitted that as per the statement of the Prosecutrix she was 19 years old and herself gone to Maharashtra. There is no role assigned to the Applicant who has been falsely implicated in this case. 3.

Learned APP for State has contended that the Application has already been declared a Proclaimed Offender on 01.04.2025 by the learned ASJ in terms of Section 70 (2) and Section 6 POCSO Act. Since, he has been declared a Proclaimed Offender, the present Anticipatory Bail is not maintainable.

After some submissions, learned counsel for the Applicant seeks permission to withdraw the present Anticipatory Bail Application without prejudice to his rights under the various provisions of law. 5.

In view of the submissions made, learned counsel for the Petitioner/Applicant is permitted to withdraw the present Petition, with liberty as prayed for.

The Petition stands disposed of accordingly.
