Petitioner herein is aggrieved by order dated 21.10.2024 whereby his application moved under Order VII Rule 11 CPC has been dismissed. 2.

Naturally, petitioner herein is defendant and is defending a suit which is commercial in nature.

Matter was adjourned as the impugned order was not on record. 4.

Learned counsel for petitioner, however, submits that there is subsequent development and the learned Trial Court has already passed a decree against the defendant on 03.07.2025. He also submits that such decree has already been assailed by him by filing an appeal before this Court. In view of the above, without prejudice to his rights and contentions, petitioner is no longer desirous of pursuing his present petition which has rather become infructuous. 5.

The present petition is accordingly disposed of as having become infructuous.
