The petitioners in the present petition seek directions to the respondent/GNCTD to start distribution of ration to 1443 families listed at Annexure A-5, who are occupying B.I.W. Camp, Badarpur, New Delhi, in compliance with the order dated 27.4.2020, passed in W.P. (C) 2161/2017 entitled Delhi Rozi-Roti Adhikar Abhiyan Vs. Union of India & Ors. 2.

We may note that vide order dated 26.5.2020, DB-I had directed that the present petition be placed before this Bench to be taken up alongwith W.P. (C) 2161/2017, which is listed at item No.3 in today's cause list. 3.

At the outset, Mr. Sanjay Jain, learned ASG appearing with Mr. Anuj Aggarwal, ASC for the respondent/GNCTD, submits that officers of the Department had examined the list placed at Annexure P-5 and have conducted a W.P. (C) No.3249/2020 Page 1 of 2

random check by picking up 154 names from the said list. Out of the said 154 names, it has transpired that 99 persons are ration card holders and in the case of 20 persons, ration card applications have been rejected. He submits that the rest of the list also needs to be scrutinized so that there is no duplication as the resources of the State are thin need to be evenly spread amongst deserving persons. This can only be done if learned counsel for the petitioner cooperates with the Department and assists them in going through the list and identifying the names, contact details, etc., of the persons for purposes of verification. 4.

Ms. Sneha Mukherjee, learned counsel for the petitioners states that she has no objection to joining hands with an officer, who may be named by the respondent/Department so that they can go through the list together and identify the deserving persons/families, for distribution of ration. 5.

In view of the submission made above, the present petition is disposed of with directions issued to the respondent/State to identify the persons covered under any existing scheme for distribution of ration from Annexure-5, within three days, and start distributing ration from the fourth day onwards. Leave is also granted to learned counsel for the petitioner to assist the Court in the main petition, i.e., W.P.(C)2161/2020.
