Petitioner/tenant has assailed order dated 16.01.2025 of the learned trial court holding that since the mediation settlement could not be finalized, trial be proceeded further. It appears that in the proceedings under Section 14(1)(e) of the Delhi Rent Control Act, parties were referred to Mediation Centre, Tis Hazari Courts, Delhi but later, the present respondent/landlord expressed unwillingness to accept the settlement. Further, it appears that for eviction of the present petitioner/tenant from the subject property, the respondent/landlord was also expected to pay Rs.12,00,000/-. Most importantly, the mediator even seems to have sanctified the pagri transaction.

Accordingly, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought, making it clear that the learned trial court shall take independent view as to whether such mediation settlement can be enforced in law.
