The counsel for the appellant, in view of the preliminary objections being raised by the counsel for the respondent on the maintainability of the present appeal, concedes that the appeal in the present form is not maintainable and as such, has made a motion for withdrawal of the present appeal.

Accordingly, the present appeal stands disposed of as withdrawn. 3.

The admissible court fee be processed and refunded accordingly as per law.
