% 04.04.2019 By way of this petition, modification of order of 13th February, 2019 is sought. Vide aforesaid order, petitioner had been granted bail subject to deposit of ₹1,50,000/- in Court on every 25th of the month. Petitioner's counsel submits that application for modification of aforesaid order of 13th February, 2019 was filed and the trial court vide order of 26th March, 2019 has called for reply to this application without dispensing with the condition of pre-deposit of ₹1,50,000/- per month. Learned counsel for petitioner submits that by now, petitioner has already deposited amount of ₹3,00,000/- till date.

Upon hearing and on perusal of impugned orders, I find this application to be premature and it is accordingly disposed of with liberty to petitioner to press his application for modification of order of 13th February, 2019 before the trial court. However, till petitioner's said application for modification is decided by the trial court, precondition of CRL.M.C. 1790/2019

deposit of ₹1,50,000/- per month be kept in abeyance. With aforesaid directions, this petition and the application are disposed of without commenting upon merits of the impugned order. Dasti.
