W.P.(CRL) 841/2020 This writ petition is filed by petitioner seeking interim parole for 45 days in terms of the directions issued by Director General(Prisons), Prison Head Quarters, Tihar, New Delhi vide circular dated 02.04.2020.
The learned ASC for the State objects to filing of the writ petition since the appeal is pending and notice has already been issued
in the sentence suspension application, hence the appropriate remedy for the petitioner is to file an application seeking interim suspension of sentence in the pending appeal.
In view of above, the learned counsel for petitioner seeks to withdraw the petition with liberty to file an application for interim suspension of sentence in the pending appeal. The writ petition is dismissed as withdrawn with the liberty as aforesaid.
