The accused/applicant seeks regular bail in case FIR No. 148/2025 of Police Station GTB Enclave, Shahdara for offence under Section 65(1)/351(3) BNS and Section 6 POCSO Act.

Broadly speaking, allegation against the accused/applicant is that he raped the 12-13 years old girl, who was his neighbour. In her statement under Section 164 CrPC, the prosecutrix stated that she was raped forcibly, but in her chief-examination during trial, she stated that the sexual intercourse between her and the accused/applicant was with her consent. Learned APP for State on instructions submits that parents of the prosecutrix have supported prosecution.

After part arguments, learned counsel for accused/applicant seeks permission to withdraw this bail application. As requested, the bail application and the pending application are dismissed as withdrawn.
