The present writ petition has been filed seeking a direction to the respondent authorities no. 1 to 4 to take action against the unauthorized construction raised at property bearing No.1381 (part), land underneath measuring 55 sq.yds., Gali Gote Wali, Mohalla Sangtarashan, Paharganj, New Delhi-110055 (hereinafter referred to as the 'subject property'), carried out by the builder/Mr. Ashok Kumar.

It is the case of the petitioner that the petitioner had paid the builder a sum of Rs.1,10,000/- towards a Bayana Agreement dated 11.12.2025 in respect of the subject property.

Subsequently, the petitioner came to know that the builder has carried out unauthorized construction in the subject property. Counsel appearing on behalf of the respondent-MCD submits that the subject property has already been booked and after following due process of law, demolition order has also been passed against the builder on 8th April, 2026.

In view thereof, the present writ petition is disposed of while directing the respondent-MCD to take action in accordance with law. 6.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the owner/occupier are kept open.

Pending application stands disposed of.
