CM APPL.12538/2024 (filed on behalf of appellant for withdrawal of present appeal) 1.

This is an application filed by the applicant/appellant seeking leave to withdraw the present petition in view of a settlement having been arrived at between the parties during the course of mediation. The factum of the settlement is affirmed by learned counsel for the respondents and also by the appellant and respondents, who are present in person. 2.

In view of the aforesaid, the present appeal is dismissed as withdrawn. 3.

Para-9 of the present application mentions that there is typographical mistake in the settlement agreement between the parties inasmuch as the address of the suit property has been wrongly typed as H-1014, Vikas Puri, New Delhi instead of H-104, Vikas Puri, New Delhi. At joint request of respective counsel, it is directed that the address of the property in the settlement agreement be read as H-104, Vikas Puri, New Delhi.

Since the parties have arrived at a settlement during the course of mediation, let the court fees paid by the appellant for the purpose of the RFA No.291/2019 and CS No.611574/2016 (before ADJ, Tis Hazari Courts, Delhi), be refunded to the learned counsel for the appellant. 6.

The application stands disposed of.
