A Petition under Section 528 BNSS has been filed by the Petitioners for quashing of the FIR bearing No. 131/2017 under Sections 279/304A IPC, registered at Police Station Ghazipur.

Briefly stated, on 17.05.2017 at about 02:30 A.M the Petitioner was driving a Crane as there was repair work going on the Road. The Respondent No.3 along with her three year old daughter deboarded the bus and in the process the child Baby Savita came in front of the crane and unfortunately died. Accordingly, an FIR No.131/2017 under Sections 279/304 A IPC was registered at Police Station Ghazipur against the Petitioners.

Rs.5,20,000/- from Motor Accident Claims Tribunal. It is further submitted that both the Petitioners and respondent No. 2 and 3 have already sorted out their all differences with the intervention of their respective persons of the vicinity vide Settlement Deed dated 25.03.2025 and they have left no grudge or grievance against each other in any manner whatsoever. By virtue of this Settlement Rs.60,000/- in addition have also been paid by the Petitioners to the Respondents. Therefore, the Petition be quashed. 4.
The Respondent No.3 is present in the Court and submits that the matter stands settled with the Petitioners. She has no objection if the FIR is quashed against the petitioners on account of the settlement already arrived at between the parties.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 6.
In view of the submissions made, the Petition is allowed. Accordingly, FIR No.131/2017 under Sections 279/304 A IPC registered at Police Station Ghazipur with all the subsequent proceedings and the Chargesheet is hereby quashed qua all the Petitioners.

The Petition stands disposed of.
