The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter "BNSS") [earlier Section 482 of the Code of Criminal Procedure, 1973 (hereinafter "CrPC")] has been filed by the petitioner praying for quashing of FIR no. 0063/2023 registered at Police Station New Friends Colony for offences punishable under Sections 279/337 of the Indian Penal Code, 1860 (hereinafter "IPC"). A chargesheet was subsequently filed in this matter.

The petitioner is the drivercum-owner of the offending vehicle who was driving the car and the respondents no. 2 to 5 were travelling by a TSR which was hit accidentally by the offending vehicle of the petitioner. Consequence of which, the FIR got registered against the petitioner.

Learned counsel appearing on behalf of the petitioner submitted that the petitioner and respondents no. 2 to 5 have settled their disputes amicably and are now moving forward towards a peaceful and harmonious future. 4.

Mediation Settlement dated 06.03.2024 is on record and has been annexed as "Annexure P-3". Qua this Settlement, the respondents no. 2 to 5 has agreed to withdraw the case arising out of FIR no. 0063/2023 registered at Police Station New Friends Colony against the petitioner. 5.

It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the mediation settlement. 6.

Learned APP for the State, who appears on advance notice, accepts notice and submits that there is no opposition to the prayer made by the petitioners seeking quashing of the FIR in question in view of the settlement arrived at between the parties.

Heard learned counsel for the parties and perused the record. 8.

The petitioner is present before this Court and has been identified by his counsel and Investigating Officer, Police Station N. F. Colony. Respondents no. 2 to 5 are also present in the Court and have been identified by the Investigating Officer.

On a query made by this Court, respondents no. 2 to 5 have categorically stated that they have entered into compromise on their own free will and without any pressure. dispute has been amicably settled between the parties and that they entirety of the amount stated in the settlement agreement has been received by them.. 10.

Keeping in view the fact that the matter stands amicably been settled between the petitioner and respondents no. 2 to 5 amicably without any pressure, no fruitful purpose would be served by keeping the matter pending. 11.

Hence, in light of the judgment of the Hon'ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR no. 0063/2023 registered at Police Station N. F. Colony for offences punishable under Sections 279/337 of the IPC, and consequent proceedings emanating therefrom, are quashed qua the present petitioner. 12.

The petition along with pending application(s), if any, stands disposed of.
