O R D E R

% 01.06.2020 Pursuant to proceedings dated 28.05.2020, the verification report has been submitted by the State which indicates that the averments that had been made by the applicant in relation to the ailment of the mother of the applicant as well as the ailment of the brother of the applicant are correct. It is however submitted on behalf of the State by the learned APP for the State as well as submitted through the status report that the condition of the applicant's mother is not life-threatening and that one of the co-accused, the father of the applicant Mr. Riyazuddin is absconding and the previous application of the applicant seeking bail have been declined, the present application be dismissed.

On a consideration of the rival submissions that have been made on behalf of either side, taking into account the factum that the applicant has been incarcerated since 31.08.2019 and in view of the medical document that had been placed on record on behalf of the applicant having been

verified by the State and as the other brother of the applicant at home is also stated to be bed ridden, in the interest of justice, the applicant is allowed to be released on interim bail for a period of 14 days with effect from the date of his release on submission of a bail bond of Rs.50,000/- with one surety of the like amount to the satisfaction of the Superintendent Jail, Delhi with directions that he shall not leave the city of Delhi and shall make no contact with the complainant and the prosecution witnesses and shall telephonically report to the Investigating Officer of the case every 3rd day and shall also keep his mobile phone on for his location being available and furthermore, the applicant shall not be involved in the commission of any offence whatsoever. In the event of there being any FIR or DD entry being registered against the applicant, the State shall bring it to the notice of the Court forthwith.

The applicant shall surrender on the 14th day of his release before the Superintendent Jail, Delhi.

The petition is disposed of.
