The present writ petition has been filed by the petitioner praying for grant of parole for a period of three months for providing proper medical treatment to his ailing mother as well as to his wife who is having stone in kidney.

Notice. Learned ASC for the State accepts notice. 3.

Nominal roll of the petitioner has also been placed on record as per which the Petitioner has availed three weeks furlough w.e.f. 23.10.2015 to 13.11.2015. As per Parole/Furlough Guidelines-2010, a minimum period of six months ought to have elapsed from the date of termination of the previous parole/furlough.

The petitioner is seeking parole mainly on the ground of illness of his wife who is having stone in kidney and in addition, ailment of his mother. W.P.(CRL) 166/2016

Alongwith the writ petition, no medical record has been annexed highlighting serious condition of his mother or wife requiring his release on parole or to show that the disease is being suffered by his wife and his mother subsequent to his availing furlough for a period of three weeks w.e.f. 23.10.2015 to 13.11.2015. Even as per the status report, the wife of the petitioner failed to produce any treatment record. 5.

In the given circumstances, the prayer of the Petitioner for releasing him on parole is hereby rejected.

Accordingly, the writ petition is dismissed.

Petitioner be informed through concerned Jail Superintendent about the orders passed.
