The present petition has been filed by the Petitioner who claims to be vending food items near the DAV School, DDA Market, Yusuf Sarai, South Zone, Delhi.

The prayer in this petition, inter alia, is for issuance of the Certificate of Vending. Ms. Kalra, ld. Counsel for the MCD submits that the Petitioner has concealed the fact that the CoV has already been issued to the Petitioner under the category of 'Others'. The copy of the CoV has been shown to the Court. 6.

Mr. Aditya, ld. Counsel for the Petitioner submits that the CoV was never received by the Petitioner.

Be that as it may since the CoV bearing URI No. 4919919 is already stated to be issued, the prayers in the present petition stand satisfied. 8.

However, as per the CoV shown to the Court the Petitioner is obviously not a person, who is permitted to use the gas cylinder. 9.

Accordingly, the petition is disposed of with the following directions: i) a copy of the CoV along with the terms and conditions be given to the Petitioner today itself.

ii) The Petitioner shall abide by the terms and conditions of the CoV and shall not use a gas cylinder.

iii) The Petitioner shall operate as a mobile vendor. iv) Subject to the Petitioner abiding by the terms and conditions of the CoV, the Petitioner's vending activities shall not be disturbed. 10.
