Petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioners seeking quashing of FIR No. 0145/2023 dated 02.03.2023 registered under Sections 377/506/34 IPC read with Sections 4/17 of the Protection of Children from Sexual Offence Act at P.S. Jagat Puri and all the proceedings emanating therefrom in terms of the Settlement dated 11.12.2024.

The FIR No. 0145/2023 was got registered under Sections 377/506/34 IPC read with Sections 4/17 of the Protection of Children from Sexual Offence Act at P.S. Jagat Puri on the basis of complaint made by the Complainant.

have been identified by their Counsel and concerned Investigating Officer. 4.

The Petition is supported by the Affidavit of the Respondent No. 2/the Victim, who is now 18 years old. The father of the Respondent No. 2 is also present in the Court.

It is submitted that essentially, it was a matrimonial dispute between the Petitioner No. 2 and her husband and their son, who is the Victim was made a scapegoat in the entire dispute. Now, the disputes have already been settled in terms of Settlement dated 11.12.2024 6.

The Victim is present in the Court and states that it was out of aggression that the FIR was registered and submits that it may be quashed. 7.

The parties have endorsed the amicable settlement and accepted the terms thereof voluntarily and they submit that the said Settlement has been arrived at between the parties, without any pressure and coercion and that they shall remain bound by the terms of the settlement. 8.

In view of the submissions made and considering that essentially, this FIR is an outcome of matrimonial dispute between the parents of the Victim the FIR No. 0145/2023 dated 02.03.2023 registered under Sections 377/506/34 IPC read with Sections 4/17 of the Protection of Children from Sexual Offence Act at P.S. Jagat Puri with all the subsequent proceedings is hereby quashed.

The Petition alongwith pending Applications, if any, stands disposed of.
