The present bail application has been filed seeking interim bail in FIR No.64/2018, registered under Sections 22/23/29 NDPS Act at Police Station Special Cell, Delhi on the ground that the petitioner's wife has to undergo spinal surgery on 02.06.2020.

In terms of the direction given on the last date of hearing, a Status Report has been filed and placed on record by the State and the medical documents of the petitioner's wife have been verified from the concerned doctor i.e., Dr. P.D. Gupta. In the Status Report, it has been stated that the surgery of the petitioner's wife is scheduled to be performed on 02.06.2020 and it is stated to be necessary.

Learned APP for the State, on instructions from the IO Anuj Kumar,
Special Cell, submits that the charges have been framed and the trial is in progress.

In view of the totality of the facts and circumstances and the fact that the petitioner's wife has to undergo surgery on 02.06.2020, the petitioner is admitted to interim bail for a period of 10 days from the date of his release on his furnishing a personal bond in the sum of Rs.50,000/- to the satisfaction of the concerned Jail Superintendent. In view of the COVID-19 pandemic, resolution dated 07.04.2020 of the 'High Powered Committee' and the consequent order dated 09.04.2020 passed by the Division Bench of this Court in W.P.(CRL.) 779/2020 titled as "Court Of Its Motion v. State", the requirement of furnishing a surety bond is dispensed with.
Further, grant of interim bail to the petitioner is subject to the following conditions:- (i) The petitioner will provide his mobile telephone number to the IO Anuj Kumar, Special Cell, which he undertakes to keep operational at all times during the period of his release on interim bail. (ii) The petitioner shall remain in touch with the IO Anuj Kumar, Special Cell on his mobile number (M-9868344272) on every Monday and Friday during the aforesaid period.
(iii) The petitioner will not leave the jurisdiction of NCT of Delhi without the prior intimation to the concerned IO/SHO. (iv) At the expiry of the interim bail period, the petitioner shall surrender before the concerned Jail Superintendent. In case, the surgery of the petitioner's wife is not performed on the scheduled date i.e., 02.06.2020, the petitioner shall surrender on 03.06.2020.

The bail application is disposed of in the above terms. 6.
