O R D E R

% 22.01.2016 Present writ petition has been filed by the petitioner under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure seeking a direction to the respondents to produce her husband, Sh.Niraj Kumar, who has been illegally detained by respondents no.4 to 6 since 5.1.2016.

On the last date of hearing counsel for the petitioner had informed the Court that no case is pending against the husband of the petitioner, he is not

involved in any money transaction case, and to the best of his knowledge the dispute is between the father-in-law of the petitioner and one, Sh.Jai Singh, who is instrumental in using his influence in having the husband of the petitioner illegally detained. Notice was issued to respondents no.4 to 6 for today. Today, SI Hari Narain, SHO, P.S. Kherli, Rajasthan, is present in Court. He submits that the husband of the petitioner was arrested pursuant to an FIR bearing no. 333 registered under Sections 420/468/467/468/471/120-B, IPC, at Police Station Kherli, Rajasthan. A copy of the FIR has been handed over to the Court as also to the counsel for the petitioner in Court. In view of the FIR lodged against the husband of the petitioner, learned counsel for the petitioner submits that he does not wish to press the present petition with leave to take recourse to such remedies, as may be available to him in accordance with law.

Accordingly, petition stands disposed of.
