The present application has been filed under Section 439 Cr.P.C. seeking regular bail in FIR No. 20/2020 under Sections 307/34 IPC registered at P.S. Narela.

Learned counsel for the petitioner submits that the petitioner has been in custody since 08.01.2020 and the injuries on the child have been opined to be simple in nature. He further submits that the charge-sheet stands filed and the petitioner is six months pregnant and presently lodged in Mandoli Jail.

A Status Report has been filed. As per the Status Report, the injuries were inflicted on a one-month old child. It is stated that during a dispute between the petitioner and her husband, who were living as tenants on the
first floor of the house, the complainant and his family members tried to intervene and when the petitioner and her husband came down to their house, the present petitioner inflicted injuries on the neck of the child. A Medical Status Report dated 08.06.2020 has also been received from the Jail Authority wherein it is stated that the petitioner is in the sixth month of pregnancy. It is further stated in the Medical Status Report that 'at present in Covid-19 scenario, pregnancy itself is under high risk of Covid-19 infection'.

In view of the medical status report, the petitioner is admitted to bail on her furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like amount to the satisfaction of the Jail Superintendent/Duty M.M./Concerned Court and subject to the following conditions :- (i) The petitioner shall not try to get in touch with the complainant or any other prosecution witness directly or indirectly and shall not make any effort to tamper with the evidence.
(ii) The petitioner shall not leave the jurisdiction of NCT of Delhi without prior intimation to the IO SI Sachin (Mob. No. 9718943417).
(iii) The petitioner shall provide her mobile telephone/landline number as well as her residential address to IO/SHO, P.S. Narela and in case of change in the same, shall bring it to the notice of IO/SHO.

The application stands disposed of in the above terms.
