This is an application under Section 439 Cr.P.C. for grant of regular bail to the applicant in case FIR No.711/2023 dated 11.10.2023 under Sections 394/397/34 IPC and Sections 25/27/54/59 of Arms Act, 1959 registered at PS: Mundka. Subsequently, Sections 395/412 IPC were added in the Charge Sheet.

Learned counsel for the applicant, at the outset, seeks to withdraw the application with liberty to approach the Court after the complainant's evidence is concluded.

Application is disposed of as withdrawn with liberty as prayed for, in accordance with law. Trial Court is requested to ensure that no adjournment is given when the matter is listed for arguments on charge and if the charge is framed, complainant be examined at the earliest and as a first witness for prosecution.
