Learned Counsel for the Respondents submits that the challenge in the present Appeal is to a dismissal of an Application under Order 39 Rules 1 and 2 of the Code of Civil Procedure, 1908 [hereinafter referred to as the "CPC"] and the challenge is not maintainable before this Court. 3.
This Court agrees with the contention of the learned Counsel for the Respondents. A revision petition is not maintainable against an order disposing of an Application under Order 39 Rules 1 and 2 of the CPC. 4.
The present Petition is accordingly dismissed. However, liberty is granted to the Petitioner to take appropriate steps in accordance with law for redressal of his grievances.
