This hearing has been held through video conferencing. 2.

The Petitioner in the present case has been charged under Sections 302/364/471/201/120B/34 of the Indian Penal Code, 1860. As per the nominal roll, he was arrested on 19th March, 2015 and has been in custody for more than 4 years and 11 months. In the past, he has been granted interim bail four times, thrice in 2019 and once in 2020. As per the nominal roll, his jail conduct is satisfactory and there are no other pending cases against him. The status report shows that whenever the Petitioner was granted interim bail, he has surrendered on time. 3.

Considering the above facts, as also the decision of the High Powered Committee dated 18th May, 2020, which states that "Under trial prisoners (UTPs) facing trial for a case under Section 302 IPC and are in jail for more than two years with no involvement in any other case" should be considered for interim bail for 45 days, though this is an application for By:PRATHIBA M SINGH

regular bail, at this point, interim bail is considered by this Court. The conditions for grant of interim bail are satisfied, in view of the information given on the Nominal roll.

Accordingly, interim bail of 45 days is granted to the Petitioner on the following terms and conditions:

1) He shall furnish a personal bond to the tune of Rs.10,000/- with one surety of the like amount to the satisfaction of the Jail Superintendent, Central Jail-1, Tihar, New Delhi.

2) He shall not leave the territory of Delhi

3) He shall provide his active mobile number to the Investigating Officer and shall contact him every alternate day. In case there is any change in his address or mobile number, he shall keep the Investigating Officer informed.

4) He shall also report to the SHO, PS Mangol Puri every Monday at 11:00 am.

5) He shall not contact any of the witnesses arrayed by the prosecution or interfere in any manner with the ongoing trial in the Trial Court. 5.

The bail application, along with all pending applications, is disposed of in the above terms. The Petitioner shall surrender immediately upon the expiry of 45 days. If the Petitioner wishes to seek regular bail, he may do so, in accordance with law. Copy of the order be communicated to the Jail Superintendent, Central Jail-1, Tihar, New Delhi. PRATHIBA M.
