The present writ petition has been filed seeking directions to the respondents to take action against the Phat-Phat Sewa operators for interfering with and/or stopping the vehicles of the petitioners, plying on the permitted route, and for complying with the Resolution No. 31/1999, passed by respondent no. 1. As per Resolution no. 31/1999 dated 1st November, 1999 passed by respondent no. 1, it has been held that "Phat-Phat Sewa Operators" cannot ply on the routes, for which Maxi Cab permits are allotted.

transport. Respondent no. 1 in order to ensure that cheap and better transport services are available in the congested area of Delhi started allotting permits for Maxi Cabs. The petitioners were allotted several permits for plying Maxi Cabs from the route from Fountain (Chandni Chowk) to Harsh Vihar in the year 2017. However, the petitioners have not been able to carry out their trade and occupation due to misconduct and harassment being caused by the "Phat-Phat Sewa" Operators, who were illegally plying on the route allotted to the petitioners.

Petitioners made several representations to the respondents in this regard. However, no action was taken. Thus, the present writ petition came to be filed.

The respondent no. 1, i.e., Govt. of NCT of Delhi ("GNCTD"), has filed its reply, the relevant portion of which, is reproduced as under: "xxx xxx xxx

10. It is submitted that the representation of the petitioner for change in route has already been granted and hence petitioner cannot be said to be aggrieved as his grievance has been met.

11. Further as per Resolution No. 01/2022 the approved routes for Phat Phat Sewa are Khajuri to Fatehpuri Railway Station, Fatehpuri to Pant Hospital, Ajmeri Gate and Mori Gate to Chauhan Patti. As per Resolution No. 02/2022 the routes allotted to Maxi Cabs as Anand Vihar to Old Delhi Railway Station via Dilshad Garden-Seelampur and Anand Vihar to New Delhi Railway Station via Dilshad Garden-Shahdara-Seelampur.

Therefore, the grievance expressed in the petition that Phat Phat Sewa is overriding and encroaching upon Maxi Cab routes has become irrelevant as the disputed route no longer exists. In view of the above-stated facts, it is respectfully submitted that there is no noncompliance with the order dated 01.11.1999, and the present affidavit clarifies the issues raised before this Hon'ble Court. xxx xxx xxx"

Perusal of the aforesaid shows that the representation of the petitioner has been duly considered and the "Phat-Phat Sewa" is no longer plying on the routes where the Maxi Cabs of the petitioners ply. 6.

Learned counsel for the petitioners submits that in view of the aforesaid reply filed on behalf of the GNCTD, the petitioners are satisfied and the dispute no long exists.

Accordingly, the present writ petition, along with pending application, is disposed of, as satisfied.
