O R D E R

% 09.04.2019 By the present petition filed under Article 226 of the Constitution of India read with Section 482 of Code of Criminal Procedure, the petitioner seeks parole for a period of 30 days on the ground of marriage of his daughter scheduled for 20.04.2019.

Status report has been filed.

Heard.

Nominal roll of the petitioner has been filed. Perusal of the nominal roll of the petitioner shows that he is undergoing Rigorous Imprisonment for the offence punishable under Section 7 and 13(1)(d) read with Section 13(2) of Prevention of Corruption Act in case RC No. 5(A)/94 registered at Police Station - CBI/ACB, New Delhi.

The petitioner has already undergone 08 months and 18 days of incarceration and also earned remission of 02 months as on 09.04.2019. The jail conduct of the petitioner has been found to be satisfactory.

Status report filed by the State confirms the factum of marriage of Ms.Anjana Meena, elder daughter of the petitioner is scheduled for 20.04.2019 at Raman Kunj, Bijli Cotton Mill Compound, Mendu Road, Hathras, UP.

Keeping in view the facts and circumstances of the present case, the present petition is allowed. The petitioner is directed to be released on parole for a period of three weeks, from the date of his release, subject to : i) his furnishing personal bond with one local surety in the sum of Rs.20,000/- to the satisfaction of the Jail Superintendent; ii) he shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent;

iii) he shall duly surrender at the end of the period of parole; iv) he shall also not indulge in any criminal activity during the period of parole.

A copy of this order be communicated to the Jail Superintendant concerned.

Copy of this order be given dasti under the signatures of Court Master, as prayed.
