The learned counsel for the petitioner submits that the prayer A in the petition has already been satisfied and he does not wish to press the same.

After some arguments, the learned counsel for the parties are at ad idem that the application under Section 311 filed by the petitioner for recalling of PW1 has not been decided by the learned Trial Court. They both agree that the learned Trial Court can be directed to pass an order in the said application before proceeding further with the matter.
